Why have rules of evidence?

  1. Mistrust of juries
  2. Substantitive policies related to matter being litigated (tilt balance in one direction or other)
  3. Substantive policies unrelated to matter being litigated (impact behavior outside of courtroom--spousal privilege for example)
  4. Ensure accurate fact-finding (want a base level of reliability)
  5. Pragmatic concerns
